By registering as a merchant on Chylux, you agree to abide by these Terms and Conditions. If you do not agree to these terms, you should not use our platform to sell products or services.
2. Merchant Accounts
a. Account Creation:
Merchants must create an account to sell on Chylux. You are required to provide accurate, complete, and up-to-date information about your business, including your legal name, contact information, and payment details. Chylux reserves the right to verify this information and, if necessary, request additional documentation.
b. Account Security:
You are responsible for maintaining the confidentiality of your account credentials. You are liable for all activities that occur under your account, and you must notify Chylux immediately if you suspect any unauthorized use of your account.
3. Product Listings
a. Accuracy of Listings:
You must provide accurate descriptions, images, and pricing for all products listed on Chylux. Misleading or incorrect product information is not allowed, and merchants are responsible for delivering exactly what the customer orders. Failure to do so may result in penalties, refunds, or account suspension.
b. Product Images:
Product listings must include clear, high-quality images that accurately represent the product. Stock images or misleading visuals are not allowed. Chylux reserves the right to remove any listings that do not comply with this requirement.
c. Prohibited Products:
Merchants are prohibited from listing counterfeit goods, illegal products, or items that promote hate speech, violence, or discrimination. Chylux has zero tolerance for such violations, and any seller found to be engaging in these activities will face immediate account termination.
4. Pricing and Commissions
a. Pricing:
Merchants are responsible for setting their own prices on Chylux. Prices should reflect the actual value of the product, and any attempts to manipulate prices, such as price gouging or deceptive pricing practices, are strictly prohibited.
b. Commission:
Chylux charges a 7% commission on each sale made through the platform. This commission is deducted from the total sale amount before the seller receives payment. Chylux reserves the right to adjust the commission rate and will provide notice of any changes in advance.
c. Payment Schedule:
Payments to merchants are processed based on the following criteria:
- Unverified Sellers: Payments will be made after the product is delivered and confirmed by the buyer.
- Verified Sellers: Payments are made after the product is shipped.
5. Shipping and Fulfillment
a. Shipping Responsibility:
Merchants are responsible for packaging and shipping products to buyers in a timely manner. You must use the shipping methods outlined in your listing and provide tracking information to Chylux and the buyer once the item is shipped.
b. Shipping Delays:
If there are any delays in shipping, you must notify the buyer immediately. Repeated delays or failure to ship products may result in penalties, including suspension of your selling privileges.
c. Shipping Costs:
Merchants are responsible for setting shipping costs based on the product’s size, weight, and destination. You may offer free shipping at your discretion, but any shipping fees should be clearly communicated to the buyer during the checkout process.
6. Returns and Refunds
a. Return Policy:
Merchants must establish and clearly communicate their return policy in their product listings. You are required to honor your return policy, including accepting returns and issuing refunds when necessary.
b. Refunds:
If a product is significantly different from its description, damaged, or not delivered, buyers are entitled to request a refund. Chylux may intervene in disputes and, at its discretion, issue refunds to buyers on behalf of the seller. In such cases, the refund amount may be deducted from the seller’s account balance.
c. Dispute Resolution:
Chylux will assist in resolving disputes between buyers and sellers. If a resolution cannot be reached, Chylux reserves the right to make a final decision and take action, including issuing refunds, returns, or suspensions.
7. Intellectual Property
As a merchant on Chylux, you represent and warrant that you own or have the necessary rights to use and sell all products listed on the platform. You agree that you will not infringe on any third-party intellectual property rights, including but not limited to copyrights, trademarks, and patents.
If you are found to be selling counterfeit or infringing products, Chylux reserves the right to terminate your account without notice and take legal action.
8. Compliance with Laws
Merchants must comply with all applicable local, national, and international laws and regulations related to the sale of goods. This includes tax regulations, product safety laws, and consumer protection laws. Merchants are solely responsible for ensuring that their products comply with all relevant regulations.
9. Buyer Protection
Chylux offers Buyer Protection to ensure that buyers receive their products as described. If a buyer claims that the product is significantly different from the listing or that it was not delivered, Chylux will investigate the claim and may issue a refund. Merchants are expected to cooperate fully in these investigations.
10. Suspension and Termination
Chylux reserves the right to suspend or terminate your account if you violate any of these Terms and Conditions. Reasons for suspension or termination may include, but are not limited to:
- Providing inaccurate or misleading product information
- Repeated shipping delays
- Selling prohibited or counterfeit products
- Engaging in fraudulent or unlawful activities
If your account is terminated, you will no longer have access to your account, and any pending payments may be withheld pending investigation.
11. Limitation of Liability
Chylux provides a platform for merchants to sell products, but we do not own or control the products listed. We are not responsible for:
- The quality, safety, or legality of products sold by merchants
- The accuracy of product listings or descriptions
- Shipping delays or issues
Our liability to you, whether in contract, tort, or otherwise, will not exceed the total commission fees earned from your sales in the past six months.
